1. Agreement to Terms

By accessing or using MyDigest (the "Service") at mydigest.fyi, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

MyDigest provides AI-powered personalized news digests delivered as text and audio. The Service includes:

• Daily personalized news digests based on your professional profile and interests
• AI-generated audio summaries of news content
• Competitor tracking and industry insights
• Multiple subscription tiers with varying features
• Optional features including "Scholarly Mode" (formerly Founder Mode) and "Pivot Hell" competitive intelligence tools

3. User Accounts

3.1 Registration

To use the Service, you must create an account via Google OAuth or LinkedIn OAuth. You agree to:

• Provide accurate and complete information
• Maintain the security of your account
• Promptly update any changes to your information
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.

4. Subscription Plans and Billing

4.1 Plans

We offer multiple subscription tiers:

• Standard (Free): Basic features with limited functionality
• Plus: Enhanced features with monthly subscription
• Pro: Full access to all features including advanced AI capabilities

4.2 Billing

• Paid subscriptions are billed monthly in advance
• All fees are in USD unless otherwise stated
• You authorize us to charge your payment method for all fees
• Subscriptions automatically renew unless cancelled
• We use Stripe for payment processing and do not store your full payment details

4.3 Cancellation and Refunds

• You may cancel your subscription at any time through your account settings
• Cancellations take effect at the end of the current billing period
• We do not provide refunds for partial months
• Upon cancellation, you retain access until the end of the paid period

4.4 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes will apply to subsequent billing periods after notice is provided.

5. Acceptable Use

You agree NOT to:

• Violate any laws or regulations
• Infringe on intellectual property rights of others
• Transmit harmful code, viruses, or malware
• Attempt to gain unauthorized access to the Service or related systems
• Use the Service for any automated or high-volume access (scraping, bots, etc.) without permission
• Resell, redistribute, or commercially exploit the Service content
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Share your account credentials with others

6. Intellectual Property

6.1 Our Content

The Service, including its original content, features, and functionality, is owned by MyDigest and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Content

You retain ownership of any content you provide (preferences, topics, etc.). By using the Service, you grant us a license to use, store, and process this content to provide the Service.

6.3 Generated Content

AI-generated digests and summaries are created for your personal use. While you may share individual digest items, you may not republish or redistribute digests at scale without permission.

7. Third-Party Services and Content

The Service integrates with third-party services (Google, LinkedIn, Perplexity AI, ElevenLabs, Stripe) and aggregates news from various sources. We are not responsible for:

• The accuracy, completeness, or timeliness of third-party content
• The availability or functionality of third-party services
• Third-party terms of service or privacy policies
• Any damages resulting from your use of third-party services

8. Disclaimers and Limitations

8.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 No Professional Advice

Content provided through the Service is for informational purposes only and does not constitute professional, financial, legal, or investment advice. You should not make decisions based solely on Service content without consulting appropriate professionals.

8.3 AI-Generated Content

AI-generated summaries may contain inaccuracies or errors. We do not guarantee the accuracy, completeness, or reliability of AI-generated content. Always verify important information from original sources.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYDIGEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of third parties on the Service
• Unauthorized access, use, or alteration of your content
• Any other matter relating to the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR $100 USD, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless MyDigest, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any rights of another party
• Your use of the Service

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Violation of applicable laws
• Fraudulent or abusive behavior
• Upon your request

Upon termination, your right to use the Service will immediately cease. All provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

13. Dispute Resolution

13.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@mydigest.fyi. We'll try to resolve the dispute informally by contacting you via email.

13.2 Binding Arbitration

If we cannot resolve the dispute informally, any dispute arising from these Terms or the Service will be resolved through binding arbitration, except that either party may seek injunctive relief in court for infringement of intellectual property rights.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15. Miscellaneous

15.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and MyDigest regarding the Service.

15.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be removed and the remaining provisions will remain in full force and effect.

15.3 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

15.4 Waiver

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
